SERVICE TERMS AGREEMENT

This Agreement is entered into as of the date of enrollment (the “Effective Date”) by and between KickstartCo, a UK-based company with its principal place of business at Second Floor, Berkeley Square House, Berkeley Square, London, England, W1J 6BD (the “Company”), and the individual enrolling (the “Member”).

1. Services:

KickstartCo provides career-focused training (the "Program") aimed at achieving results for Members in their respective careers. The Program may be updated or revised from time to time at the Company’s sole discretion.

2. Membership Terms:

Membership is valid for the period stated upon enrollment ("Membership Term") and, if applicable, will automatically renew for additional periods of the same duration unless either party provides notice of non-renewal at least thirty (30) days prior to the end of the then-current term.

3. Payment Terms:

The Member agrees to pay the membership fee in accordance with the payment terms and pricing presented upon enrollment.

4. Member’s Commitments:

The Member agrees to use the Program in accordance with all applicable laws, regulations, and the Company's policies and procedures. The Member also agrees to act respectfully and contribute positively to the Program.

At KickstartCo, we care deeply about our student experience. We are committed to upholding principles of courtesy, inclusivity, and kindness. We expect communication within KickstartCo to always reflect these values.

KickstartCo Communication Policy:

  • Harassment and Discrimination: Harassment or discrimination of any kind, including but not limited to race, gender, age, religion, sexual orientation, or disability, is strictly prohibited.

  • Offensive Language: Offensive or abusive language, personal attacks, or threats toward fellow users, staff, or any individuals will not be tolerated.

  • Solicitation or Self-Promotion: The solicitation or self-promotion of any kind is forbidden, including indirect promotion on behalf of others.

  • Inappropriate Content: Posting or sharing explicit, inappropriate, or offensive content is prohibited.

  • Confidential Information: Unauthorized sharing of confidential Company information is prohibited.

  • Spamming: Spamming or unsolicited marketing messages are not allowed.

  • Legal Violations: Any actions that violate applicable laws or regulations are prohibited.

Communication Guidelines:

  • Respect: Always treat others with respect, kindness, and empathy.

  • Positivity: Foster positivity and encourage constructive discussions.

  • Relevance: Stay on topic and focus on the Program content and objectives.

  • Diversity: Embrace different perspectives and engage in constructive dialogue.

KickstartCo reserves the right to suspend services or immediately terminate them, and in some cases pursue legal action, if: (i) the Member disrupts services, violates the communication policy, or engages in fraud or illegal activity; (ii) there is evidence of solicitation, misuse, or breach of contract; or (iii) if a Member’s account is associated with illegal actions or third-party intellectual property violations.

5. Confidentiality:

All information provided within the Program is confidential and should not be disclosed to third parties without the express consent of the Company.

6. Intellectual Property:

Content published on this website, including videos, digital downloads, images, text, graphics, and logos, is the property of KickstartCo and/or its content creators and is protected by UK and international copyright laws. You cannot download, share, or distribute any of the course content without prior written permission from KickstartCo. All materials and content provided in the Program are owned by the Company and are protected by intellectual property laws. No rights or licenses are granted to the Member except as expressly set forth in this Agreement.

7. Refund Policy:

KickstartCo values the satisfaction and success of its Members. We offer a 14-day refund policy for Members who feel they have not achieved the desired results, provided they have met the Program's requirements. Refunds are only available to students who have made a reasonable attempt to apply the course content and have participated in all necessary activities, including coaching sessions, as outlined in the Program.

Refund Request:

If you believe you qualify for a refund, you must submit a written request within fourteen (14) days of your enrollment date. Your request must include:

  • Your full name and email address

  • A copy of your payment receipt or proof of purchase

  • Documentation showing that you’ve followed the Program’s guidelines and attempted the work

Refunds will not be granted if:

  • The Member did not comply with the Program’s instructions or requirements.

  • The Member failed to attend live coaching sessions or interact with the Program materials.

  • The Member enrolled in the Program but did not meet the eligibility criteria.

Refund Eligibility Requirements:

  • The Member must actively engage in the Program, including participating in all required learning activities.

  • Members must show evidence of meeting all necessary criteria set out by KickstartCo to qualify for a refund.

Specific Program Refund Policies:

7.1 Career Development Program Refund Policy:

  • The Member must have completed at least 75% of the Program content.

  • The Member must have participated in relevant activities as outlined in the Program, including submitting applications to at least 10 companies for qualifying roles.

  • The Member must actively seek out networking opportunities and engage with the Program’s coaching elements.

  • The Member must have updated their professional profile (resume and LinkedIn) per Program instructions.

7.2 Sales Development Program Refund Policy:

  • The Member must have completed 50% of the core curriculum.

  • The Member must be actively working through the Program’s strategies and document their efforts.

  • The Member must attend at least one live Q&A session per week and seek feedback if needed.

8. Limitation of Liability:

The Company's total liability under this Agreement shall not exceed the total fees paid or payable by the Member for the Membership Term during which the event giving rise to the claim occurred.

9. Payment Plans:

When choosing the payment plan to purchase a course, you agree to allow KickstartCo to automatically charge your bank card on the recurring schedule that is described on the sales page. This consists of your initial payment plus any additional payments in accordance with the payment plan. If a payment fails, KickstartCo will automatically keep retrying to process your card. Access to the course will be removed until the payment is successful. The payment plan is not a subscription and cannot be canceled or refunded. Failure to pay your outstanding balance directly with KickstartCo will be marked as delinquent and turned over to a collections agency for retrieval of any outstanding balances.

10. Governing law:

This Agreement shall be governed by and construed in accordance with the laws of England and Wales.

11. Dispute Resolution:

Any dispute arising from this Agreement will be resolved through mediation. If mediation is unsuccessful, the dispute will be submitted for binding arbitration under the rules of the Arbitration Act 1996.
